WeMintArt offers holders the opportunity to acquire and claim physical items corresponding to NFTs. Holders are responsible for lawfully purchasing or acquiring their NFT(s) in accordance with applicable laws and regulations. WeMintArt does not provide any guarantees or representations regarding the availability, quality, or delivery of the physical items. It is the sole responsibility of the holders to comply with all applicable laws and regulations related to the acquisition, possession, and distribution of the NFTs and corresponding physical items. WeMintArt shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits or expected profits, goodwill, use, data, or other intangible losses arising out of or in connection with the use or inability to use the NFTs, the platform, the physical items, or any associated licenses, rights, or services.

7. Ownership: The purchase of an NFT establishes the buyer's ownership of a digital item. In the case of NFTs that include physical items, the purchase grants the buyer ownership of a digital item along with an iCOA (Interactive Certificate of Authenticity) that enables the buyer to claim the corresponding physical item. The ownership rights are subject to the terms and conditions outlined herein.
Purchasing an NFT requires the execution of a mint function on the Ethereum Blockchain and is solely at the discretion of the purchaser. WeMintArt does not provide any guarantees for the successful completion of such transactions and advises purchasers to exercise caution when interacting with the Ethereum Blockchain. 8. Physical Items: Purchasers and holders of the NFT (iCOA) will be eligible to own/receive the corresponding physical item. Upon minting, purchasers will have the right to claim the physical item on the designated claim page. If an NFT (iCOA) is transferred to a new owner before the physical item has been claimed, only the current holder will have the opportunity to receive the physical item. It is important to note that the availability, quality, and delivery of the physical items are subject to the Terms and Conditions established by WeMintArt. When holders engage in individual resale of the physical items, they assume the responsibility to comply with all applicable laws. Additionally, they are responsible for any costs, taxes, or fees associated with the receipt and distribution of the NFT (iCOA) and physical item. It is crucial to understand that owning the NFT (iCOA) signifies ownership of the physical item, irrespective of its location. Therefore, when engaging in the resale of physical items, it is necessary to transfer the NFT (iCOA) to the new owner to consummate the sale.
9. Digital Items: Periodically, WeMintArt may engage in the sale of NFTs that do not have corresponding Physical Items. WeMintArt hereby clarifies that these digital items are solely intended for entertainment purposes. WeMintArt does not provide any guarantees or representations regarding the availability, quality, or delivery of these digital items.
10. Other Rights: Periodically, purchasers and holders may have the opportunity to participate and provide input into decisions made by WeMintArt through surveys and polls. WeMintArt reserves the right to determine the availability and frequency of such opportunities, and the final decision-making authority rests with WeMintArt.
Additionally, purchasers and holders may occasionally have the chance to engage in gated content and meetings, participate in raffles and giveaways, and attend public and private events. The specific details regarding these opportunities, including their locations, may be disclosed or undisclosed as determined by WeMintArt.
11. Delivery of Physical Items: Upon claiming the item(s), the risk of loss and deterioration of the item(s) shall transfer to the Purchaser/Holder at the point of departure from our facility or our distributor's facility, or upon collection by the designated third-party shipper. WeMintArt reserves the right to choose third-party shippers for the delivery of physical item(s), and there may or may not be associated costs for this delivery service provided to the Purchaser/Holder.
12. Modifications and Termination: These terms and conditions shall supersede all prior verbal or written representations made by WeMintArt, whether express or implied. WeMintArt retains the right to modify or terminate the NFTs, the platform, the licenses, project programs, or any associated content or services at its sole discretion and without prior notice. Holders shall be provided with reasonable notice regarding any changes that may significantly affect their rights.
13. Severability: In the event that any provision of these terms is determined to be unlawful, the remaining provisions shall remain in full force and effect, unless the application of such provisions would result in an absurd or unreasonable outcome.
